Puffery - a lot of hot air?

It’s certainly an original title for a post; however, it’s a topic worthy of discussion. Best Price skips bins, Cheap, Cheaper, Cheapa,  Lowest Price; you’ve heard it all before. Have you ever wondered how that manage consumer law views these claims?

The ACCC refers to these types of claims as ‘puffery’ (wildly exaggerated claims)

‘Puffery’ is a term used to describe wildly exaggerated or vague claims about a product or service that no one could possibly treat seriously. For example, a restaurant claims they have the ‘best steaks on earth’. These types of statements are not considered misleading.

I had a bit of a giggle when I came across this. We see this in so many industries. So what’s wrong with this? In my reality, whilst the ACCC validates it, as consumers should we accept this. If I see a company that claims to be the cheapest or offers the lowest prices, is it not reasonable that I’d expect this to be true? Can I hope that the company would match any legitimate price without overloading their claims with a host of conditions longer than you arm?

At Skip Bins Brisbane we like to be upfront with how we price our services. We use the term ‘value for service’ because we believe service is an essential aspect of what we do. Companies make all sorts of wild and exaggerated claims; however, do they fulfil this to an acceptable level? Firstly it’s reasonable for a company to decide how they want to run their business, i.e. we close at 5 pm, and that’s it no more phone calls are answered, we accept payment by credit card or cash, these decisions are essential, that’s okay. I know there are situations where things go astray, and the best plans come unstuck. What I’m talking about is when a company tells you something or makes a claim, they cannot reasonably fulfil.
